Group sues state over water pumps

SACRAMENTO — A conservation group sued the state Wednesday, claiming it failed to determine whether a pair of federal reports allows the killing of fish at the state export pumps near Tracy.

 

A judge earlier this year ruled that the Department of Water Resources never got proper permits under state law to kill fish at the pumps.

 

The Department of Water Resources asked another state agency, the California Department of Fish and Game, to determine that the pumping operation was already covered by the federal reports, which are disputed in a separate case.

 

Water Resources later withdrew its request, but the California Sportfishing Protection Alliance, headed by Stockton environmentalist Bill Jennings, still wants Fish and Game to issue its opinion.

 

The case was filed in Alameda County Superior Court; a hearing was scheduled for Monday. #
