Source of downtown Visalia well contamination sought

Workers began drilling a series of six wells in downtown Visalia Tuesday, seeking the source of a cancer-causing chemical found in the city's water supply.

 

The wells will be in an area where California Department of Toxic Substances Control researchers found high levels of perchloroethylene (PCE) in water wells.

 

Two dry-cleaning businesses are in the area, as well as the locations of two former dry-cleaning businesses.

PCE is a solvent widely used by dry cleaners.

 

In the early 1990s, California Water Service Co. found high levels of PCE in some of its wells in and around Visalia that supply drinking water and water for firefighting.

 

Those levels were above 5 parts per billion, the maximum limit allowed for PCE in drinking water, said Phil Mirwald, the company's district manager for Visalia.

 

Four of the wells had carbon filters installed in their extraction pumps to remove the PCE and make the water safe for drinking.

 

Currently, CWS has 73 active wells in and around Visalia, Mirwald said.

 

PCE contamination has prompted the destruction of three downtown wells, all in the vicinity of the four current and former dry cleaners.

 

It's around those businesses that the new wells were being drilled Tuesday, said Mike Vivas, a mechanical engineer and site contamination cleanup manager for DTSC. His organization obtained a U.S. Environmental Protection Agency grant to begin looking at PCE levels in Visalia's groundwater in 2007.

 

Vivas said his organization has tested all 73 CWS wells and several of the 272 other private and public wells under Visalia, though he didn't know the exact number Tuesday.

 

He said CWS' water is safe for drinking, including the water coming from wells with filters.

 

Downtown

 

The downtown drilling project is intended to tap into groundwater about 90 feet below to determine the levels of PCE there, as well as in portions of soil collected during the drilling, Vivas said.

 

One of the drill sites is directly across the street from Paragon Dry Cleaners, 119 S. Willis St. A couple of blocks to the east, more drilling was being done near One Hour Martinizing, 717 W. Main St.

 

Employees at both businesses said the owners were not there and couldn't be reached for comment. Drilling also is being done near two former dry-cleaning businesses: One, at 110 N. Willis St., now is a parking lot, while the other, at 220 N. Encina St., is a law office.

 

And there are indications of at least six other dry cleaners having operated over the years in that vicinity, Vivas said.

So, how did the PCE get into the ground?

 

Up until the early 1990s, PCE could be discharged into sewers with wastewater, but concerns over it showing in groundwater and wells, along with the health risks, resulted in laws that forced dry cleaners to install washing devices that separate PCE vapors in tanks and reuse it.

 

Unfortunately, leaks, pipe breaks and spills of PCE in its liquid form result in it getting into the ground. Once there, it can eventually migrate down to the water table, Vivas said.

 

In fact, he said, soil contamination here could have occurred years ago, and only now is slowly seeping into the groundwater. The current owners of those properties — even if they aren't dry cleaners now — could be liable for at least part of the cleanup costs if the DTSC research shows their properties as the sources.

 

Karen Jurist, a site assessment manager for the EPA, said the testing and a final report on the downtown sites could be completed in a couple of months.#

California salmon fishermen face the likelihood of a second year of no fishing off the state's coastline, based on early warnings Tuesday about the need to save a dwindling salmon population.

 

 "There's really no fish to play with," said Duncan MacLean, a commercial fisherman from Half Moon Bay. Current data, he said, suggests that state and federal regulators will need to save all the available salmon in order to ensure the spawning run in the Sacramento River.

 

More than 80 fishermen, scientists, conservationists and regulators gathered Tuesday in Santa Rosa, mostly to hear about the state of Sacramento River chinook. Those fish normally make up most of the salmon caught in California and Oregon.

 

They were told that even if California fishermen stay off the water for a second straight year, the number of salmon returning to the Sacramento River will barely meet the minimum number needed for a healthy population.

 

If federal regulators were to allow some fishing, they later might have to determine that the Sacramento salmon has undergone "overfishing," a finding that could lead to stricter rules on fishermen in future years.

 

Marija Vojkovich, a state Fish & Game official and member on the federal fishery council, acknowledged that chances are slim for an ocean fishing season again this year.

 

She based that view partly on the numbers of juvenile salmon, a key indicator of how many adult salmon are expected this spring and summer. Biologists have said the number of juvenile Sacramento River salmon was the second-lowest on record last fall.

 

"That tells you there's not a lot of extra fish to harvest," Vojkovich said.

 

With the Sacramento chinook in poor shape last year, regulators banned all salmon fishing in the ocean off California and allowed only a limited fishery for coho salmon off Oregon.

 

Even so, only about 66,000 chinook returned to spawn in the Sacramento last fall, far below the minimum goal of 122,000 adults.

 

This year the federal government is predicting 122,196 adult salmon to return if all fishing is banned.

 

The Sacramento already has failed to meet the federal government's minimum goal for two years. Should that happen for a third year, the federal Pacific Fishery Management Council would be required to conduct an "overfishing" study and consider ways to boost the river's salmon population. One proposal likely would be to set aside more fish by further restricting fishing.

 

Vojkovich and other regulators noted that salmon from the Klamath River are expected to be more abundant this year. However, regulators must consider how many Sacramento fish would be caught if they were to allow fishing in the ocean near the mouth of the Klamath.

 

Both commercial fishermen and charter boat owners said they didn't want to fish if it meant risking not having enough salmon return to the Sacramento.

 

"I don't recommend a fishery," said Roger Thomas, president of the Golden Gate Fishermen's Association, a group of about 50 charter boat operators. "I don't want a fishery."

 

The fishery council in April is to receive a report on the cause of the decline of the Sacramento salmon. It will recommend whether to allow any ocean fishing off the West Coast. The U.S. Commerce Department makes the ultimate decision on ocean fishing.

 

Tuesday's meeting was held at the Sonoma County Water Agency.

 

Fishermen there continued to argue that the decline in the Sacramento salmon is tied largely to water diversions to farms and cities. But biologists maintain that poor ocean conditions also played a factor, possibly a larger factor.#

Recreational Miners Attack Indian Salmon Fishery

Happy Camp, Calif. March 3, 2009 - Since the arrival of miners in the mid 1800's the Karuk Tribe has lost nearly everything. Once the lone occupants of over 1.4 million acres of the Middle Klamath Basin, the Karuk had over 100 villages and associated fishing sites. A peaceful society blessed with an abundance of acorns, fish, and game, early observers described the Karuk as the wealthiest people in North America. Today, nearly 90% of Karuks living in ancestral territory live below the poverty level and Tribal members have access to only one fishery. Yesterday, a recreational gold mining club called The New 49ers challenged the Tribe's right to fish there.

Karuk fishermen use traditional dip nets to fish for migrating salmon as they navigate the rapids at Ishi Pishi Falls near Somes Bar, California. Salmon are harvested for subsistence and ceremonial use only and the Tribe rarely harvests more than 200 fish. This falls far short of meeting the Tribes' needs as there are 4,200 members.

In a press release, the miners charge that the Karuk Tribe is guilty of "widespread and wanton" killing of salmon.

"These accusations are ridiculous," responded Leaf Hillman, Vice-chair of the Karuk Tribe. "Our fishery is gear limited. This means that because we use traditional dip nets, we can only catch a very small percentage of fish that are coming up the falls. This is by design. The creator taught us to use dip nets in order to not over harvest fish. We would not have survived here for thousands of years had we abused this privilege granted to us by the Creator."

Although many Tribes in the Pacific Northwest use gill nets that are strung across the river, the Karuk do not. Karuk fishermen stand on rocks and dip large nets on poles into the river to catch fish. Hillman noted, "Our fishery is non-lethal. This allows us to selectively harvest fish. In other words, we release ESA listed Coho and smaller chinook back into the river unharmed and we eat the rest. It also provides opportunities to tag fish for purposes of conducting scientific studies."

The New 49ers' petition to Fish and Game comes in retribution to the Tribe's recent effort to restrict suction dredge mining in areas that serve as critical habitat for ESA listed coho and other fish listed as ‘species of special concern' under the California ESA. This includes Pacific lamprey and green sturgeon.

Suction dredges are powered by gas or diesel engines that are mounted on floating pontoons in the river. Attached to the engine is a powerful vacuum hose which the dredger uses to suction up the gravel and sand (sediment) from the bottom of the river. The material passes through a sluice box where heavier gold particles can settle into a series of riffles. The rest of the gravel is simply dumped back into the river. Often this reintroduces mercury left over from historic mining operations to the water column threatening communities downstream. Depending on size, location and density of these machines they can turn a clear running mountain stream into a murky watercourse unfit for swimming.

Suction dredging is a recreational activity that has been popularized in recent years by hobby groups and clubs such as The New 49ers.

In 2005 the Karuk Tribe sued Fish and Game for allowing the practice of suction dredge mining to occur in areas known to be critical habitat for endangered and at-risk species. At the time, Fish and Game officials submitted declarations to the Court admitting that suction dredge mining under its current regulations violates CEQA and Fish and Game Code §§5653 and 5653.9 (the statues which authorize the Department to issue permits for suction dredging under certain conditions) because the activity causes deleterious harm to fish - including endangered fish, such as the Coho salmon.

The suit ended in a court order directing Fish and Game to conduct a CEQA review and amend its regulations by June 20, 2008. Fish and Game has yet to initiate the process to change rules. Earlier this year the Tribe sued Fish and Game again in an effort to force immediate protections for fish.

The miners' suit over the Karuk fishery is retaliation for the Karuks' efforts. "Rather than address the issue head on, the miner's attorney has resorted to threats and intimidation," said Zeke Grader, of the Pacific Coast Federation of Fishermen's Associations. "People would not tolerate someone ripping up their yards or their crops in the field, but that's exactly what the miners are doing to the salmon the tribes and fishermen depend on. It's got to stop."

"We just want to do what we where doing when the first wave of miners showed up in 1850 - fish and feed our families. Over the last 150 years miners have taken nearly everything from the Karuk People. We will not allow them to take our last fishery," concluded Hillman.

To date, Fish and Game has made no public comment regarding the miners' petition.#

Commentary: Could mussels put a kink in your water system?

California farmers and ranchers are all too familiar with the water shortage currently facing the state. But another, more insidious, hard-to-see threat looms on the horizon, menacing California's ability to deliver water: quagga and zebra mussels.

 

For farmers and ranchers, quagga and zebra mussels can disrupt water distribution. The mussels cling to any hard surface their larvae contact and can quickly clog pipes, trash grates, intakes, canals, pumps—everything from the water intake to the sprinkler head.

 

Many reservoirs in California serve primarily as water distribution sources. A clogged distribution system would reduce water flow, could cost millions to control and would force a dramatic rise in farm costs. Once infested, eradication is extremely difficult.

 

The quagga mussel (Dreissena bugensis) and its sister species the zebra mussel (Dreissena polymorpha) are freshwater mussels that hail from Ukraine. They were first discovered in the Great Lakes in the late 1980s. Speculation is they were introduced through ballast water from ships.

 

Efforts to keep the mussels east of the Rockies failed, and in January 2007, they were identified in Lake Mead and the Colorado River. By the end of 2007, they had spread from California's border with Nevada throughout the river system and to associated lakes and reservoirs to San Diego County. Any water body receiving raw Colorado River water had been exposed, and several have become infested. Six counties have verified mussel populations in lakes or reservoirs: San Bernardino, Riverside, San Diego, San Benito, Orange and Imperial.

 

Zebra and quagga mussels reach a maximum size of 2 inches, and have alternating light and dark bands. Zebra mussels can attach to surfaces down to 180 feet. Quagga mussels will attach to any surface, hard or soft, to more than 400 feet.

 

Both mussels reproduce prolifically: A single mussel can release more than 40,000 eggs in a reproductive cycle and up to a million eggs in a year. Rapid and repeated reproduction makes them a serious threat to water-dependent enterprises like agriculture, power utilities and water distribution.

 

For fish, the mussels obliterate the base of the food chain by filtering out phytoplankton and zooplankton. Clearing the water causes algae blooms, which result in fish die-offs from oxygen deprivation. The mussels can hitch rides on boats and equipment either as adults or in pockets of water as larvae. Some water agencies have closed infested reservoirs and lakes to prevent the spread. Other water managers have closed their waters to all recreation to prevent infestation. The response to the mussels' presence has varied greatly.

 

The mussels have had a devastating impact on power and water distribution in the Great Lakes region. Congressional estimates of impacts in the East have been in the billions of dollars. In California, the cost could be even greater. The Metropolitan Water District of Southern California has spent millions of dollars over the past two years managing the quagga mussel infestation. San Benito Water District closed San Justo Reservoir to all boating and recreation.

 

A task force of state and federal authorities—including the Department of Fish and Game, Department of Water Resources, Department of Boating and Waterways, U.S. Fish and Wildlife Service, U.S. Bureau of Reclamation and others—focuses on preventing the spread of mussels. Nearly 2 million "quagga cards" with prevention tips have been distributed to boaters and water enthusiasts around the state.

 

Gov. Schwarzenegger signed two Assembly bills chaptered as Fish and Game Code Sections 2301 and 2302. Section 2301 primarily addresses existing infestations, and requires containment, control and response plans. Section 2302 works to keep mussels out of uninfested waters by implementation of prevention programs. The Department of Fish and Game has staff in each of its regions training inspectors, monitoring waters and working on plans to help water managers contain, control and prevent infestation.

 

For farmers, ranchers and other water-dependent enterprises, DFG recommends monitoring water systems and sources, and checking in with local water managers and agencies to see what steps have been put in place to prevent infestation. DFG is developing volunteer monitoring programs, and staff in each of its regions can assist and advise. Working together, Californians can stop the mussels from spreading and keep the water flowing. #

Despite heavy rainfall, water remains in short supply

IIt has been nearly a week since Gov. Arnold Schwarzenegger dropped the bomb, laying out a doomsday drought scenario so starkly apocalyptic he sounded like Dr. Strangelove. And yet, Justina Pillado endured weather Tuesday in the teeth of the governor's state of emergency that made her toes curl.

 

"This rain sucks," she said, stepping into another puddle in downtown San Jose. "My socks are completely drenched." Her hair was matted by the lunchtime downpour, and she shook it with a mixture of suspicion and derision when she heard a severe shortage of rain might bring about mandatory water rationing later this month. The governor has strongly urged Californians to begin conserving water.

 

"It's wet out here, man," said one of Pillado's friends as the group splashed off. "Everywhere we go there are puddles."

 

Unfortunately, puddles were what Northern California's five largest reservoirs continued to resemble as of Monday, standing at a collective glass-half-empty 46 percent of capacity, far below the 76 percent that's normal for this time of year.

 

Sometimes you need a divining rod just to locate the truth about how bad things are. As welcome as it is when the skies open up and peal rain, what accumulates on the ground in places like Sacramento is part science and part politics, as water managers wring their hands over three successive dry years, and politicians push for new dams and canals. In the balance hangs the fate of the most complex water storage and distribution system in the nation.

 

Coming restrictions

 

The dirty little secret of the current drought emergency is that San Jose got slightly more than five inches of rain in February. That is twice the average amount for the month, and more than doubles the total for the local rain season.

 

"It's been raining quite a bit," said Brian Tentinger, a meteorologist at the National Weather Service in Monterey, "and when you compound that with the fact that we hadn't gotten a lot before that, it makes it seem like even more."

 

The only thing thicker than the rain clouds that were expected to bring waves of scattered showers to the South Bay through the end of the workweek were dire warnings from the state's water nerds. Poring over statistical abstracts about what's pouring from the clouds — and what will later trickle down from the Sierra snowpack, now at 80 percent of normal — hydrologists can find the lead lining in any silver cloud.

 

The Santa Clara Valley Water District, which will vote whether to recommend water restrictions on March 24, sees the current haze of rain as a mirage. "We have short memories, and it's been raining on and off for three weeks," said Susan Siravo, spokeswoman for the water district. "So it's hard for people to remember back to January, when it was bone dry and 80 degrees outside. This rain we're getting now needs to last all the way to next November."

 

As local reservoirs rise toward their thirsty brims, the water district is coping with a two-thirds reduction in the water it imports from state and federal sources, which account for half its annual supply. With that spigot nearly shut, the only hope of avoiding bleached bones in the spray fountain at Plaza de Cesar Chavez this summer may be water rationing.

 

Skepticism reigns

 

Monica Holm, who was dodging puddles Tuesday on her way to lunch, carefully monitors the state's water level on the news every morning as she gets ready for work. Has she started taking shorter showers in response to governor's warning? No, she acknowledged, she's not conserving yet. "But I'm not using extra!" she said. "This is not like the droughts we had when I was young, and you couldn't water your lawn."

 

Reminded that those are exactly the kinds of restrictions that could be coming in a matter of weeks, she appeared crestfallen. "That's not on my mind right now," Holm said. "I'm thinking, 'Let's go skiing.' So there is a disconnect, absolutely."

 

Larry Koepke, who had washed his restored 1976 Olds Cutlass 442 in the rain Tuesday morning to reduce his use of city water, thought conservation could be a tough sell this time. "A lot of people think they've already done what they can," he said. "They've installed low-flow toilets, they've put in drip systems, some have even gotten rid of lawns. It's like, 'What more can I do?' I think human beings in general are selfish, and until we're forced to give up the comforts, we're not going to."

 

Dressed in a bright yellow slicker and pushing a broom up Santa Clara Street, Clifford Vaughn was not about to let a little rain — or a drought, for that matter — stop him from doing what must be done for the city's Groundwerks program. "I love the rain," Vaughn said, "because we need it. When July comes around, we're all going to be looking for a rain cloud."

 

Just then he looked up, and one opened on top of him, the fat drops coursing down his cheeks like tears.#

STOCKTON - Even though rain clouds filled the sky Tuesday morning, it was gloomier inside the County Courthouse as officials declared a drought in San Joaquin County after hearing recent storms have not made up for previous dry years.

 

Largely symbolic, the declaration doesn't trigger any response, but the Board of Supervisors also told staff to come back with an aggressive water-conservation ordinance, which would make possible mandatory water reductions of 15 percent or more, depending on the level of drought.

 

Only a small percentage of water used in San Joaquin County passes through the 32 water districts with 6,000 service connections in unincorporated county. Supervisors also gave the nod to phasing in water meters and coordinating with other water providers to get the word out on how to save water during a drought.

 

Recent storms brought some water, but precipitation levels and water piling up in the Sierra snowpack and local reservoirs are still below normal, said Mel Lytle, water resources coordinator for the county. "It will take a miracle March and April to bring us out of this drought," he said.

 

It's the beginning of the third year of drought, and already the groundwater level in eastern San Joaquin County is at the same level as it was at the end of a five-year drought that occurred from 1987 to 1992. "This is a big area of concern," Lytle said.

 

San Joaquin County is not alone in its water concerns. On Friday, Gov. Arnold Schwarzenegger declared a state drought emergency.

 

On Tuesday, the board directed its staff to work with other water providers in the county to pool resources in public outreach efforts and coordinate regional water conservation.

 

As it now stands, the county's conservation rules fall short of those other water agencies.

 

Proposed changes to the county ordinance would establish four tiers of water conservation, depending on drought conditions:

 

» Stage 1: Follow regular conservation measures prohibiting wasteful use during normal years.

» Stage 2: Reduce water use, voluntarily, by 10 percent in below-normal years.

» Stage 3: Reduce water use by 15 percent in serious drought years or pay surcharges.

» Stage 4: The board can declare mandatory reductions of 30 percent or more during critical water shortages.

 

Staff will return with a revised ordinance at a later meeting. Tuesday's declaration of drought would have called for Stage 3 measures, Public Works Deputy Director Steve Winkler said.

 

It will not require further action for the county to start phasing in meters at its water districts. Most county water is drawn from wells.#

Facing the probability of a zero allocation of Central Valley Project water deliveries, many western San Joaquin Valley farmers will abandon plans for planting annual crops like cotton and processing tomatoes in order to divert whatever water they have to permanent crops like almonds, pistachios and grapes.

 

That's what Mendota farmer Mike Wood and his brother, Doug, are doing. Partners in Wood Brothers Farming, located some 15 miles west of Mendota on farmland adjacent to the California Aqueduct, the Woods are fallowing about 750 acres of the 2,000 that they farm. Their primary effort will be focused on keeping alive the 300 acres of 4-year-old almond trees that they own and another 500 acres of almonds that they manage for a neighbor.

 

Similar decisions by farmers throughout the Central Valley who rely on federal and state water deliveries could lead to some 847,000 acres of farmland laying idle this year because of water shortages, according to an estimate from economists at the University of California, Davis.

 

In its initial projection of water supplies last month, the CVP warned its agricultural service contractors of a potential "zero allocation." The State Water Project estimates it will deliver only 15 percent of requested water.

 

The UC economic study estimates the water shortages could lead to the loss of as many as 80,000 jobs in the Central Valley, and up to 95,000 jobs statewide.

 

Mike Wood knows first-hand about the loss of jobs. He said he thinks the general public is sympathetic to the plight of the farmer, but most people don't see the extent of the problem.

 

"There is a domino effect here of people losing their jobs. People who believe that what's going on isn't going to affect them are probably not as well informed as they should be," he said.

 

He noted for example that at this time of year he usually would be employing 10 full-time irrigators. This year he has two. Of his two full-time tractor drivers, one currently works on an "as needed" basis and Wood says he doesn't know when, or if, he will be able to call back the other driver.

 

"Last year we didn't fallow anything, but it is a lot more complicated this year," Wood said. "This year going in, not knowing just what we will get in the way of water deliveries, we went into survival mode. Whatever canal water we manage to obtain will be dedicated to the trees."

 

There are four wells on the farm that provide some water, but of very low quality. Wood says it is akin to seawater. And it is expensive to pump from a depth of 650 feet, using 600-horsepower diesel engines. Last year when diesel fuel hit $4 per gallon, it cost about $250 an acre-foot to pump well water. Fuel prices have come down, but it is still cost-prohibitive for extensive pumping of well water and Wood said he's heard rumors that fuel prices will skyrocket again this summer.

 

"It's a two-edged sword for us because the crops we can grow with well water are not cost effective to grow because of the low commodity prices. Cotton is completely out this year for the first time in the history of this ranch. Fifty-eight years, and this will be the first year ever without cotton," he said with a shake of his head.

 

In their quest for alternative crops that can handle the salinity of well water, the Woods this year are planting 500 acres of oats for seed, 200 acres of alfalfa for seed and 175 acres of garlic. All will be irrigated with well water.

 

"This is the first time that we've ever grown oats. A person just has to start branching out in order to come up with a crop that might work in the worst-case scenario," he said.

 

Wood said he knows that California is in the midst of a drought, but he also said that dry weather forms only part of his region's water dilemma.

 

"We have a double whammy going on now. We are in the midst of a truly meteorological drought and also in the midst of a regulatory drought with the Endangered Species Act," he said.

"In the absence of our legislators actually getting a clue as to what is going on out here and doing something about it, our hopes of being sustained for a long period of time are very grim," Wood said.

 

It takes about 3 1/2 acre-feet of water to produce an almond crop and about 1 foot of water to simply keep trees alive. For Westside growers who don't have wells, the situation is very serious, he said.

 

"There are people within a five-mile radius of here who are not going to survive this. It's depressing, there's no other way to put it. The anxiety level is high out here," he said. "I'm very concerned about other people, but one reaches the point where your focus turns inward and you ask yourself, 'How do I survive?'"

 

As part of their survival mode, the Woods are hesitant to take on any additional expenses this year. When their almonds were younger, they were able to farm them using their row-crop equipment, but now that the trees are four years old that has become more difficult.

 

"We are in a position now where we need low-profile tractors, we need to buy a spray rig and maybe some harvest equipment. My brother and I sat down and had a heart-to-heart talk about where we were going to go with this and we decided we are on hold with any purchases. There is no reason to cover our business with that kind of debt when we really don't know what kind of longevity we are going to have with regard to our livelihood," he said.

 

"The other change is that my brother and I find ourselves doing some of the tasks that we'd sworn off years ago because they were tasks we grew up doing and we thought we graduated to a higher job description, to put it that way. We find ourselves driving spray rigs, road graders for ditches, all of these things that are part and parcel to the survival mode. We are trying to hang in there and keep going," he said.

 

Wood says there have been rumors going around that because of the recent storms adding to the Sierra snowpack that farmers may end up with a small allocation of federal water.

 

"Ten percent is the highest number I've heard, but it will more likely be in the neighborhood of 5 to 7 percent, but that is just a guess on my part. The other part of that issue is that by the time those decisions take place it may be too late," he said.

 

Mike and Doug Wood both have sons in their mid-20s who are college graduates and who hope to take over management of the farm when the two brothers retire.

 

"They will both come back here as fourth-generation farmers," Mike Wood said, "if the farm is still here." #

Suit seeks to block delta smelt rules

Westlands, San Luis districts cite water needs.

The Westlands Water District on Tuesday joined forces with the San Luis & Delta-Mendota Water Authority to stop the federal government from enforcing a new set of rules governing the endangered delta smelt.

 

A lawsuit filed Tuesday in U.S. District Court in Fresno says the new rules, issued in December by the U.S. Fish and Wildlife Service, "will result in significant harm to Californians who depend on [Central Valley Project] water supply."

 

The suit seeks to have the new rules governing management of the delta smelt rewritten. While that takes place, the suit asks for "relief from the pumping restrictions" in the Sacramento-San Joaquin Delta that were implemented as a result of the new rules.

 

"We understand the need to save the species," said Westlands spokeswoman Sarah Woolf. "However, there is zero balance" between the needs of water users and protection of the delta smelt.

 

Last month, the U.S. Bureau of Reclamation announced that west Valley farmers would receive no federal water this season.

 

The state's persistent drought is partly to blame, Woolf said, but without the new smelt rules, some water would have been delivered.

 

Instead, she said, an enormous amount of water flows through the delta and into the ocean to satisfy requirements for the smelt rules.

 

The California Department of Water Resources estimated in December that in an average weather year, the water-delivery cuts could range from 20% to 30%.

 

Environmentalists said Tuesday that Westlands and the San Luis & Delta-Mendota Water Authority were trying to capitalize on the state's current drought conditions to turn back the new smelt rules.

 

Trent Orr, an attorney for the environmental group Earthjustice, said Tuesday that the rules are well written. "We expect the federal government to defend this [lawsuit] rigorously," he said.

 

The rules, called a biological opinion, govern water-pumping operations by the state Department of Water Resources and U.S. Bureau of Reclamation. The two agencies operate massive water pumps that send delta water to Bay Area urban users, San Joaquin Valley farmers and south to Los Angeles and San Diego.

 

Environmentalists say the effects of delta pumping have forced the delta smelt to the brink of extinction, and they sued the federal government under the Endangered Species Act.

 

In May 2007, U.S. District Judge Oliver W. Wanger found that rules governing the smelt were flawed and needed to be rewritten. Those are the new rules that were issued in December.

 

But Tuesday's lawsuit says the newly minted opinion "ignores contrary scientific data, misstates and misapplies the data it cites" and makes claims that Central Valley Project operations are hurting the smelt, when it is actually other factors such as industrial pollution and invasive species of clams that are interfering with the food supply for the smelt.

 

The suit also says the new rules restrict delta pumping operations, but offer no "meaningful benefit to delta smelt survival or recovery."

 

Tuesday's 36-page lawsuit is similar to one filed in December over the longfin smelt, a cousin of the delta smelt.

That suit says California Department of Fish & Game regulations protecting the longfin smelt are hurting the state's water supply.

 

Taken together, Woolf said, rules governing the delta and longfin smelt show the lack of a coherent strategy to manage the delta and protect the species that dwell there.

 

Named in the lawsuit were several federal agencies, including the U.S. Bureau of Reclamation.

 

Spokeswoman Lynnette Wirth said the bureau has not seen the lawsuit and could not comment. #
